Amidst rising geopolitical tensions in the Middle East and concerns regarding potential disruptions in the Strait of Hormuz, reports have emerged of certain service providers and hotels levying unauthorized 'gas charges' or 'fuel charges' on food bills. The Department of Consumer Affairs has taken a stern view of these practices, clarifying that there is no shortage of Liquefied Petroleum Gas (LPG) in the country. The government has emphasized that such additional surcharges are illegal and constitute unfair trade practices. Consumers are being urged to remain vigilant and report any instances of overcharging to the appropriate authorities immediately.

Illegal Surcharges on Food Bills

According to reports from various urban centers, several hotels and restaurants have started adding extra line items such as 'LPG Surcharge' or 'Fuel Recovery Fee' to their invoices. Officials have stated that any charge beyond the prices mentioned in the menu and the applicable Goods and Services Tax (GST) is a violation of consumer rights. The department clarified that the cost of commercial gas used in hotel operations is already factored into the pricing of food items, while Because of this, demanding additional money under the guise of fuel costs is prohibited. Consumers are advised to scrutinize their bills before payment and challenge any non-transparent charges added by the establishment.

Government Clarification on LPG Supply

The Union Government and the Ministry of Petroleum have officially confirmed that India maintains sufficient LPG reserves to meet domestic and commercial demand. Despite the crisis in the Middle East, the supply chain remains functional and strong. According to officials, the long queues observed at some distribution points aren't due to a supply deficit but are the result of panic buying triggered by rumors spread by middlemen. The government has appealed to the public not to succumb to misinformation and to book cylinders only as per their actual requirements. Oil marketing companies have been directed to enhance monitoring at distribution centers to prevent hoarding.

How to File a Complaint via NCH 1915

The Department of Consumer Affairs, through its official communication channels, has informed citizens that if a hotel or shop demands extra money citing LPG costs, they should first ask the establishment to remove the charge, while if the vendor refuses to comply, consumers can call the National Consumer Helpline (NCH) at the toll-free number 1915. When filing a complaint, it's essential to provide the name of the establishment, the bill details, and the specific amount overcharged. The NCH acts as a central repository for grievances, ensuring they're forwarded to the relevant enforcement agencies for swift action and resolution.

Online Redressal through e-Jagriti and CCPA

To facilitate easier access to justice, the government has integrated digital platforms like 'e-Jagriti' (formerly e-Daakhil) for filing formal consumer complaints online. This portal allows consumers to submit their grievances to Consumer Commissions from the comfort of their homes. On top of that, the Central Consumer Protection Authority (CCPA) has the mandate to take suo motu cognizance of such widespread illegal practices. If an establishment is found guilty of systemic overcharging, the CCPA can impose heavy penalties and recommend the cancellation of trade licenses. Written complaints can also be submitted to the District Magistrate (DM) office for local intervention.

Consumer Rights and Preventive Measures

The department has issued specific guidelines to protect consumers from exploitation during periods of market volatility, while customers must ensure they receive a valid tax invoice for every transaction. According to officials, using the pretext of a supply crisis to intimidate consumers into paying more is a punishable offense under the Consumer Protection Act, while the government has also reiterated that demanding more than the stipulated delivery charges for LPG cylinders is against the rules. In case of a dispute, consumers are encouraged to maintain evidence, such as photographs of the bill or digital records, to strengthen their case during legal proceedings.
