This is said, Odisha High Court High Court's Judge Justice SK Panigrahi said that there is no clear in the law, because of the long time in the case of marriage, the accused could not get punished for a long time on the promise of marriage. While hearing on the bail plea of ​​an accused, he said, "In existing circumstances, there is nothing clear about the punishment of accused in the law. Because of this, in many cases the accused could not get punishment." He said that in this case the earliest needs need to be amended.

Justice Panigrahi said, "The law that raped by the promise of marriage is wrong. However, while discussing the question of the sufferings of the victim and the accused, there is a need to take care of the dignity of the victim and his family."

In fact, the young man locked the bail petition was filed in jail for making long-term physical relation by making a false promise of marriage. It is alleged that he promises to marry a woman long to create physical relations. He also made pregnant twice and later made an abortion by giving medicines. Later the young man refused to marry. After this, when the woman's marriage was fixed elsewhere, she shared the personal photo by making a fake account on social media. In this case the youth was arrested and sent to jail on June 27 last year. However, the High Court rejected the accused's bail plea.

Justice Panigrahi said, "In the Section 375 (rap) of the IPC, the relationship made with the woman in which circumstances will be considered as a rape, but the promise of marriage for a long time physical relationship in Section-375 No. So, to decide the impact of consent under Section-375, the provisions of the IPC need to be seen seriously. " He also said that rape laws should be used to regulate the Intimate Relations, especially in those cases where women go to relationship with their own will.

Justice Panigrahi further said that there are many complaints from socially backward and deprived sections of society and rural areas. The women of these sections often give men sex by giving greed to the false promises and after being pregnant, they are left. The High Court found that rape laws do not justice with socially backward and poor women, who are trapped in the wedding false promise to make physical relation.
