Justice Surya Kant has articulated a definitive stance on the integration of Artificial Intelligence (AI) within the judicial framework, asserting that while technology can Notably augment legal research and administrative efficiency, it can't supersede the core element of judicial discretion. During a significant bilateral meeting with Judge Ulrich Herrmann, a presiding judge from the Federal Court of Justice in Karlsruhe, Germany, the Justice emphasized that AI is a tool designed to enhance judicial reasoning rather than a replacement for the human intellect and moral judgment required in the delivery of justice.

The Scope of AI in Judicial Research and Translation

The integration of AI in the Indian judiciary is currently focused on streamlining repetitive and labor-intensive tasks. Justice Surya Kant pointed out that AI is being effectively utilized for legal research, the translation of complex judicial pronouncements, and providing citizens with real-time updates regarding their cases. The primary objective behind adopting this technology is to reduce the burden of routine administrative functions, thereby allowing judicial officers to focus more on the substantive aspects of law. By automating the transcription of proceedings and the preparation of schedules, AI helps in maintaining a more organized and accessible judicial record.

Strict Prohibitions on AI in Critical Decision-Making

Despite the advantages of technology, the Chief Justice was clear about the boundaries that AI must not cross. According to the draft rules formulated by the Supreme Court's AI Committee, there are strict prohibitions on using AI for evaluating the credibility of witnesses. On top of that, AI can't be employed to assess the risk of a person fleeing, the likelihood of recidivism, or the eligibility of an individual for bail. These areas require a deep understanding of human behavior, social context, and legal nuances that AI currently can't replicate. The final responsibility for these life-altering decisions remains solely with human judges.

Proposed Oversight and Accountability

To ensure that the use of AI remains ethical and transparent, a proposal has been made to establish a permanent apex body. This institution would be responsible for monitoring the use of AI within the judicial system and ensuring accountability. Justice Surya Kant highlighted that as we embrace new technologies, it's imperative to define the parameters of their responsibility, while the goal is to make the justice system faster and more efficient without compromising the integrity of the judicial process.

Maintaining Judicial Independence and Public Trust

The Chief Justice noted that both the Indian and German judicial systems share a fundamental responsibility: maintaining judicial independence and public trust. He stated that while technology and administrative reforms can assist in this mission, they can't replace the careful administration of justice, human judgment, and loyalty to the law, while the evolution of judicial institutions must align with new expectations for access to justice and modern litigation methods.

Advancements in Dispute Resolution

The discussion also touched upon recent initiatives like the Special Lok Adalat 'Samadhan Samaroh', institutional arbitration centers, and digital Lok Adalats. These platforms have made it easier for people living far from major cities to access settlement facilities. Supported by trained professionals, case managers, and secure digital systems, these initiatives represent the successful blend of technology and human expertise in the pursuit of justice.
