In a major development emerging from Delhi concerning the Cockroach Janata Party, CJP leaders Saurabh Das and Ashutosh Ranka have successfully walked out of Tihar Jail. Notably, they secured their bail following written assurances provided to the authorities, which has triggered a wave of joy and celebration among CJP supporters. The entire legal proceeding unfolded before the court of the Special Executive Magistrate in Delhi.
Tihar Jail Wards and Initial Preventive Action
Specific details regarding their detention reveal the exact jail numbers where both leaders were lodged. Ashutosh Ranka was held in Jail Number 4, while Saurabh Das was confined in Jail Number 2. On October 14, 2026, both Ashutosh Ranka and Saurabh Das were presented before the court under preventive action based on apprehensions of a breach of peace and public order disruption. Initially, the court remanded both individuals to judicial custody for five days. This custody period was subsequently extended by another two days, valid up to October 21, 2026.
Police Plea and Court Arguments
On October 21, 2026, the Special Executive Magistrate court in Delhi issued a crucial order regarding the case of Ashutosh Ranka and Saurabh Das. The investigating officer filed a fresh application before the court, seeking a further extension of three days in their judicial custody. The police argued that given their conduct, alleged discrepancies between statements made to the media and the court, and shifts in their stance, apprehensions regarding the deterioration of law and order still persisted, while however, the court dismissed this police plea for extending the judicial custody.
Unconditional Apology and Written Assurances
During the proceedings, an unconditional verbal apology was tendered regarding a statement given to the media while being transported to Tihar Jail, while it was alleged that this statement had impacted the dignity of the Special Executive Magistrate court. Also, Ashutosh Ranka and Saurabh Das voluntarily submitted written assurances to the court. These assurances explicitly stated that they wouldn't engage in any activity that breaches peace, that they've complete faith in the judiciary, that they wouldn't issue a call for protests at Jantar Mantar until it's removed from the notified list through legal procedures, and that any future protests would strictly remain within the framework of the Constitution.
Release Orders and Conditions
The court concluded that keeping both individuals in further judicial custody at this stage was unnecessary. According to the order, the objective of preventive action under Section 135(3) of the Bharatiya Nagarik Suraksha Sanhita could be fulfilled through bonds and written assurances. The court ordered their release upon furnishing personal bonds of 50000 rupees and a surety bond of the same amount until the investigation proceedings are completed. Following the submission of bonds and prima facie verification of the sureties' documents by the court, an immediate release order was issued, and a release warrant was sent to the Superintendent of Tihar Jail.
Court Directives and Next Hearing
The court also laid down specific conditions and instructions in the matter. The investigating officer must submit a verification report of the sureties by the next hearing. Both respondents must remain present at every hearing, and the sureties are also required to attend on each date of hearing. Also, both individuals must maintain law and order and strictly adhere to the written assurances submitted in court. The next hearing for the case is scheduled for October 23, 2026, on Friday at 3 PM.
