The Food Safety and Standards Authority of India (FSSAI) has taken a stern stance against misleading advertisements and labeling violations by issuing notices to several Food Business Operators (FBOs). This regulatory action comes as part of FSSAI's ongoing efforts to protect consumer interests and ensure absolute transparency in the food industry. The authority has raised serious concerns over claims such as 'Fresh Paneer' and 'Vegan', directing the concerned companies to strictly adhere to established norms and implement necessary rectifications immediately.
Violations Under FSS Act 2006
The food regulator has identified multiple operators who have allegedly violated the provisions of the Food Safety and Standards (FSS) Act 2006. These FBOs have been instructed to provide a detailed explanation within 7 days as to why legal action shouldn't be initiated against them under the rules and regulations of the FSS Act. The FSSAI emphasized that all food businesses must operate within the legal framework to maintain food safety standards across the country and avoid misleading the public through incorrect labeling.
The Case of Heritage Fresh Paneer
One of the primary targets of this action is Heritage Foods Limited. FSSAI received a complaint regarding their product 'Heritage Fresh Paneer', which used the claim 'Fresh Paneer'. According to the regulator, this claim is misleading as it doesn't meet the specific conditions laid down for the use of the word 'fresh' under Schedule 5 of the regulations. FSSAI clarified that such terminology can provide incorrect information to consumers, leading to a breach of trust and regulatory standards. All FBOs have been reminded that labeling rules are non-negotiable and must be followed strictly.
Action Against Other Major Brands
The crackdown by FSSAI isn't limited to dairy products alone. The regulator has also issued a notice to 'La Casa Vegan Hazelnut Chocolate Spread' for its claims of being 'Vegan', '100% Organic', and 'All Natural'. On top of that, 'Sipzer Nutraceuticals Juice Capsule' has come under fire for misleading claims stating that the product is 'FSSAI Approved' and 'made with organic vegetables'. FSSAI noted that these claims were made without proper authorization or adherence to the specific standards required for such labels.
Previous Crackdown on Energy Drinks
This isn't the first time FSSAI has moved against prominent brands. Previously, the regulator issued notices to several beverage companies including Hell Energy Drink, Adrenaline Rush Energy Drink, Red Bull Energy Drink, and Sting Energy Drink. The objection was raised against marketing these products as 'energy drinks' because there is no notified standard for 'energy drinks' under the Food Safety and Standards Regulations. FSSAI explicitly stated that companies can't make functional or therapeutic claims, such as increasing energy, improving focus, or relieving general weakness, unless such claims are specifically permitted under the FSS Act 2006 and related regulations.
Ensuring Consumer Protection
FSSAI has reiterated that all these actions are being taken in the best interest of the consumers. The objective is to ensure that food products don't carry labels or claims that mislead the public or imply regulatory approvals that have not been granted, while the regulator has issued a final warning to all companies to maintain transparency in their labeling and advertisements. Any further violation of these rules will result in even stricter legal consequences as FSSAI continues its vigil over the food sector.
