In a move aimed at promoting social welfare and women's empowerment, the state government has decided to grant 365 days of paid maternity leave to female government employees even for the birth of their third child. The announcement was made by the Minister for Human Resources Management, D. Sarathkumar, during a session in the State Assembly on Tuesday, while while participating in a debate on the demands for grants for his department, the Minister highlighted the government's commitment to being a welfare-oriented administration. He stated that since the Tamil Nadu government prioritizes social welfare and the empowerment of women, it has been decided to increase the maternity leave for the third child from the current 12 weeks to a full year of 365 days. This policy change is intended to provide better support to mother and child during the crucial first year of infancy.
Transition from 12 Weeks to One Year
Prior to this announcement, the maternity leave policy in Tamil Nadu had different provisions based on the number of surviving children. Married female government employees with fewer than two surviving children were entitled to 365 days of maternity leave with full pay. However, those who already had two or more surviving children were only eligible for 12 weeks, which is approximately 84 days, of maternity leave with full pay for their subsequent child. The provision for 12 weeks of leave for the third child was previously aligned with the Supreme Court's interpretation, which maintained that maternity benefits can't be denied for the birth of a third child. By extending this to 365 days, the Tamil Nadu government has gone beyond the minimum legal requirements to provide uniform benefits across the first three children.
MLA R. Pallavi Brings Newborn to Assembly
The government's announcement coincided with a notable event in the State Assembly involving R. Pallavi, a first-time MLA from the Tamizhaga Vettri Kazhagam (TVK). MLA Pallavi drew significant attention when she arrived at the Assembly premises with her newborn baby. According to sources, she brought the infant to the Assembly complex and left the child with a caregiver in a room near the Assembly building before entering the main hall to participate in the legislative proceedings. The caregiver looked after the newborn until the MLA returned from the session, while while some individuals on social media questioned her decision to bring the baby to the Assembly, Pallavi responded by stating that she couldn't leave her newborn at home. She appealed to the public not to comment without understanding an individual's specific circumstances and challenges.
Historical Progression of Maternity Leave in Tamil Nadu
The maternity leave policy in Tamil Nadu has seen several upward revisions over the past decade. In 2011, the original maternity leave period of 90 days was increased to 6 months. Later, in 2016, this period was further extended to nine months. In July 2021, during the tenures of the Dravida Munnetra Kazhagam (DMK) and All India Anna Dravida Munnetra Kazhagam (AIADMK) governments, the leave was finally increased to one full year or 365 days for the first two children. The latest decision now extends this one-year benefit to the third child as well, reflecting a continuous trend of expanding support for female employees.
Implementation and Government Orders
A government source clarified that the benefit of 365 days of leave is typically available to regular female employees under prescribed eligibility rules. Following the announcement by Minister Sarathkumar in the Assembly, a senior official confirmed that a detailed Government Order (GO) regarding this amendment will be issued shortly. This order will formalize the transition and provide the necessary framework for departments to implement the extended maternity leave for the third child, ensuring that all eligible female government employees can avail of this benefit with full pay as per the new regulations.
