BJP vs AAP / Supreme Court issued notice to the central government regarding the ordinance

BJP vs AAP: The country's highest court has issued notice to the central government on a petition against the ordinance on control of services in Delhi. The Delhi government has filed this petition in the Supreme Court. While hearing this petition, the court has asked the Center to explain its stand. A bench of Chief Justice DY Chandrachud and Justice PS Narasimha heard the petition filed by the Delhi government. The court will now hear the matter next on July 17.

The ordinance came into force on May 19

Significantly, the Central Government on May 19 promulgated the Government of National Capital Territory of Delhi (Amendment) Ordinance, 2023 to create an authority for transfer and posting of Group-A officers in Delhi. The ordinance came at a time when the Supreme Court had ordered handing over the control of police, public order and other services except land to the elected government of Delhi.

Lieutenant Governor was made powerful in the ordinance

Under the central government's ordinance, the lieutenant governor has been given the right to take the final decision related to the transfer and posting of officers in Delhi. Under the National Capital Territory of Delhi (Amendment) Ordinance, 2023, a National Capital Public Service Authority will be constituted for transfer and disciplinary action against Group A officers of cadre serving in Delhi. There will be three members of this authority. In which the Chief Minister of Delhi, Chief Secretary of Delhi, Home Principal Secretary of Delhi will be there. The Chief Minister of Delhi has been made the chairman of this authority.
