In a significant legal setback for the senior Samajwadi Party leader, Azam Khan has been convicted by a Rampur court in a case involving a controversial statement made during the 2019 Lok Sabha election campaign. The MP-MLA court of Rampur, after completing the trial, found the veteran politician guilty of making derogatory and threatening remarks against the then District Magistrate (DM) of the district. This verdict adds to the mounting legal challenges faced by the Khan family, as the leader is already serving time in jail for various other convictions.
The 2019 Election Controversy
The roots of this case trace back to the high-decibel campaigning of the 2019 Lok Sabha elections. Azam Khan, who was the Samajwadi Party candidate at the time, was addressing a public gathering in the Bhot police station area. During his speech, he launched a scathing attack on the then District Magistrate of Rampur. The speech, which quickly went viral on social media and news platforms, contained several inflammatory remarks that were deemed a violation of the Model Code of Conduct and other legal provisions.
In the viral video of the speech, Azam Khan was heard referring to the administrative officials as "Tankhaiya" (salaried servants). He urged the public not to be intimidated by them. Plus, he made a controversial reference to an alliance, stating that they had partnered with those who make people clean shoes. He went on to claim that, "Insha Allah," after winning the elections, he would make the officials clean shoes, while his remarks also reportedly included a mention of Bahujan Samaj Party (BSP) chief Mayawati, reflecting the political alliances of that period.
Legal Proceedings and Court Verdict
Following the controversial speech, a case was registered against Azam Khan under various sections related to hate speech and the violation of the Model Code of Conduct. The legal battle has been ongoing in the special MP-MLA court in Rampur for several years. During the trial, the prosecution presented evidence, including the video recordings of the speech and testimonies from witnesses who were present at the rally.
The defense argued against the charges, but after hearing the arguments from both sides and examining the evidence, the court of Magistrate Trial Shobhit Bansal reached a conclusion. The court found Azam Khan guilty of the charges leveled against him. Consequently, the judge announced a sentence of 2 years of imprisonment. In addition to the jail term, a financial penalty of 5000 rupees was also imposed on the senior leader.
Impact on Azam Khan's Political Career
This conviction isn't the first for Azam Khan. The former Uttar Pradesh cabinet minister has been embroiled in numerous legal battles ranging from land encroachment to hate speech, while he has already lost his assembly membership in the past due to a previous conviction. Currently lodged in jail, this new sentence further complicates his legal standing and political future. The verdict is seen as a major blow to the Samajwadi Party in the Rampur region, which has long been considered a stronghold for Azam Khan.
The legal team for Azam Khan is expected to challenge this decision in a higher court. However, for now, the 2-year sentence stands as a stern reminder of the legal consequences of inflammatory rhetoric during election cycles. The Rampur MP-MLA court's decision emphasizes the judiciary's stance on maintaining the decorum of public discourse and upholding the Model Code of Conduct during democratic processes.
