The Supreme Court of India on Friday made significant observations regarding the Other Backward Classes (OBC) reservation and the concept of the creamy layer. During the hearing of a petition related to the reservation criteria for the creamy layer within the backward classes, the apex court raised a pertinent question about the necessity of reservation for children whose parents have already achieved high social and professional status, specifically citing the example of IAS officers.

Questioning Reservation for Children of High-Ranking Officials

A bench comprising Justice Nagarathna expressed concerns over the continued demand for reservation benefits by individuals whose families have already attained significant educational and economic empowerment. The court pointed out that if both parents are serving as IAS officers, the rationale for providing reservation to their children comes under scrutiny. " This observation highlights the court's perspective on how professional success and high-ranking government service impact the social standing of a family.

Social Mobility and Empowerment

The court emphasized that educational and economic empowerment are the primary drivers of social mobility. According to Justice Nagarathna, once a family achieves a certain level of education and economic stability through reservation or other means, they move up the social ladder. She stated, "Educational and economic empowerment leads to social mobility. So, the demand for reservation for children will never be able to get out of this. " The bench suggested that when parents are in good jobs and earning a substantial income, their children should ideally step out of the reservation ambit to allow others who are more in need to benefit.

Distinction Between EWS and OBC Creamy Layer

During the proceedings, the court also touched upon the differences between the Economically Weaker Section (EWS) and the OBC creamy layer. Justice Nagarathna noted that the EWS category is based solely on economic backwardness, whereas OBC reservation is rooted in social and educational backwardness. She argued that there should be a clear distinction between the two. The court observed that the criteria for the creamy layer in OBC should be more liberal compared to EWS, but a balance must be maintained. "If both are considered equal, there will be no difference left," the judge remarked, highlighting the need for a nuanced approach to these categories.

The Need for Deliberation

The Supreme Court stated that the issue of high-income individuals and children of top-tier government officials seeking reservation requires deep deliberation. The bench noted that while some government orders already exist to exclude such individuals from reservation benefits, these exclusions are often challenged. Justice Nagarathna pointed out that when parents have already utilized reservation to reach a certain level of education and are now in well-positioned government services, the social mobility is evident. The court concluded that these factors must be taken into account while deciding on the criteria for the creamy layer. Despite these strong observations, the bench has issued a notice on the petition to further examine the matter.
