The Supreme Court of India is scheduled to hear a significant petition today, October 15, filed by prominent leaders of the INDIA block, including the Leader of the Opposition in the Lok Sabha, Rahul Gandhi. The hearing will be conducted by a bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi, and Justice V Mohana. This legal challenge brings to the forefront critical concerns regarding the functioning of the Election Commission of India (ECI) and the integrity of the electoral rolls used in the democratic process.

Core Allegations and Demands of the Petitioners

The petition, which has been signed by a total of 13 individuals, primarily challenges several recent decisions made by the Election Commission. One of the most significant demands made by the opposition leaders is a stay on the Special Intensive Revision (SIR) process, while " In light of these allegations, the petitioners have also sought the intervention of the apex court and have called for the resignation of the Chief Election Commissioner, Gyanesh Kumar.

Procedural Hurdles and Rectification of Defects

The path to this hearing was marked by several procedural delays. Initially, the Supreme Court registry had identified a total of 14 defects in the petition, which prevented it from being listed for a hearing on October 13. These defects included issues such as unclear identification documents, missing or illegible pages, and the absence of a Vakalatnama for some of the petitioners. Plus, there was a minor deficit of 220 rupees in the required court fees. After these discrepancies were addressed and rectified, the petition was officially recorded. During this process, two additional petitioners joined the cause, bringing the total number of petitioners to 13. In a related development, the Delhi Metro Rail Corporation (DMRC) also submitted an unconditional apology to the Supreme Court on Wednesday regarding a contempt case.

Demand for Independent Oversight and Technical Audit

A major highlight of the petition is the demand for transparency regarding the Special Intensive Revision process that commenced on June 24, 2025. The opposition leaders have requested the court to direct the ECI to submit all relevant documents, including minutes of meetings, internal notations, and logs from the ECINET and ERONET systems. To ensure a fair assessment, they've proposed the formation of an independent committee of technical experts. This committee, they suggest, should be headed by a retired judge of the Supreme Court and should be tasked with conducting an impartial audit of the voter deletion process and the technology and procedures associated with Electronic Voting Machines (EVMs).

Ensuring Transparency and Protecting Voting Rights

The petitioners have further insisted that the reasons for deleting voter names during the SIR must be made public. They've demanded the release of booth-wise lists of all deleted voters along with specific justifications for each deletion. A critical plea in the petition is for a total ban on removing any citizen's name from the voter list without providing prior notice and a fair opportunity for a hearing. Also, the petition calls for strict action against officials who violate constitutional mandates, the reinstatement of older rules for online Form-6 applications, and the implementation of strong measures to safeguard every citizen's fundamental right to vote.
