Ajay Devgn and Tiger Shroff Respond to FDA Notice Over Pan Masala Ad

Actors Ajay Devgn and Tiger Shroff have submitted their responses to the Maharashtra FDA regarding a show-cause notice for surrogate advertising of pan masala. While their replies are under review, the department is still awaiting a response from Shah Rukh Khan concerning the Vimal Elaichi advertisement.

The Maharashtra Food and Drug Administration (FDA) is currently conducting a comprehensive investigation into the promotional activities associated with Vimal Elaichi. This investigation is centered on allegations of surrogate advertising, a practice where a brand uses the name or identity of one product to indirectly promote another product that may be restricted or banned. In this specific case, the FDA had issued formal show-cause notices to three prominent Bollywood actors: Ajay Devgn, Tiger Shroff, and Shah Rukh Khan. The notices sought clarification from the actors regarding their participation in advertisements that allegedly promote prohibited pan masala through the guise of other products.

Current Status of Actor Responses

According to official sources within the FDA, both Ajay Devgn and Tiger Shroff have already submitted their formal replies to the notices served to them. These responses were reportedly received by the department approximately two days ago. The FDA is now in the process of meticulously reviewing the contents of these replies to determine if there has been any violation of the existing regulations. On the other hand, the department is still waiting for a response from Shah Rukh Khan. As of the latest updates, no official communication has been received from his legal or professional team, and the FDA continues to anticipate his explanation regarding the matter.

Legal Framework and Regulations

The notices issued to the three actors were based on alleged violations of the Advertising and Claims Regulations, 2018. These regulations are designed to ensure that advertisements are truthful and don't mislead consumers through indirect promotions of restricted substances, while the FDA had specifically asked the actors to provide their stance on the advertisements and the claims made within them. The investigation aims to uncover whether the promotion of Vimal Elaichi serves as a surrogate for banned pan masala products, which would constitute a breach of the 2018 regulatory framework.

Ban on Tobacco and Pan Masala in Maharashtra

It's important to note that the state of Maharashtra has maintained a strict ban on gutkha, pan masala, and all tobacco-related products for several years. FDA Commissioner Tukaram Mundhe has highlighted that these products have been prohibited in the state since the year 2012. The commissioner emphasized that the administration is actively investigating actors who participate in advertisements for such products to ensure compliance with the law. The ban is part of a long-standing public health initiative to curb the consumption of harmful substances across the state.

Commissioner Tukaram Mundhe on FDA Performance

Commissioner Tukaram Mundhe also shared insights into the functioning of the FDA under his leadership. He stated that since he took charge as the FDA Commissioner, the department's activity and efficiency have seen a significant increase of more than 300 percent. He noted that this growth is clearly reflected in the official data and statistics of the department. Also, addressing a context related to a previous remark by the Bombay High Court, Mundhe made a notable statement. The Bombay High Court had previously questioned whether he considered himself God, implying that he could act without constraints. " This statement highlights his perspective on his administrative role and the ongoing efforts of the FDA to enforce regulations strictly.
