CBI has at least 173 pending investigations in nine states. CBI cannot initiate investigation of any new case without the permission of the states. CBI is not able to investigate 132 cases only in Maharashtra. Here the Mahavikas Aghadi government has withdrawn the consensus under Section 6 of the Delhi Special Police Establishment Act. Similarly, many other non-BJP ruled states have also tied the hands of CBI.

Responding to the question of BJP MP Sushil Modi, Union Minister Jitendra Singh said that there are 16 pending requests in Punjab, 8 in Chhattisgarh, 7 in Jharkhand, 6 in West Bengal and two each in Rajasthan and Kerala. Maharashtra is at the forefront in this matter. Meghalaya and Mizoram, along with all these states, withdrew the consensus for a CBI probe in 2015 itself. After this, the CBI has to take permission from the states before taking up any new case. The governments of the states said that the central government was using the central agency against them.

Jitendra Singh informed the Parliament that out of 173 pending cases, 128 cases are of bank scams. Bank scams of Rs 21074 crore are not coming under CBI investigation due to lack of state approval. Union Minister Jitendra Singh said that only in Maharashtra, while answering the question of pending BJP MP Sushil Modi in 101 bank fraud cases, he said That 16 requests are pending in Punjab, 8 in Chhattisgarh, 7 in Jharkhand, 6 in West Bengal and two each in Rajasthan and Kerala.
