Supreme Court Refuses To Change Jantar Mantar High Powered Committee Composition

The Supreme Court of India has taken a decisive stand regarding the ongoing investigation into the Jantar Mantar protest incidents. In a significant development, the apex court has categorically refused to entertain any requests for changes in the composition of the High-Powered Inquiry Committee (HPEC) that was previously constituted to probe the matter. The court emphasized that the integrity of the committee shouldn't be questioned based on mere perceptions or assumptions, especially when the investigation is in its nascent stages.

Mandate for the High-Powered Inquiry Committee

The Supreme Court has provided a clear and comprehensive roadmap for the HPEC to follow as it moves forward with its investigation, while the committee has been directed to prioritize several critical aspects of the Jantar Mantar incidents. These include the alleged use of pellet guns during the protests, which has been a point of significant concern. On top of that, the committee is tasked with investigating allegations of female protesters being specifically targeted and subjected to alleged misconduct by the authorities.

The scope of the inquiry also extends to the broader aspects of the violence that transpired. The HPEC will examine instances of excessive violence and the resulting damage to property, ensuring that accountability is established for losses incurred by both sides involved in the conflict, while the bench, presided over by Chief Justice of India (CJI) Surya Kant, issued these directives to ensure a thorough and impartial probe into the events.

Addressing Concerns Over Committee Composition

During the proceedings, the Supreme Court addressed the demands made by certain petitioners who sought a change in the structure of the HPEC. The court noted that the committee has not yet fully commenced its investigation, making it premature to raise objections based on preconceived notions. The court clarified that the primary objective of the HPEC is to assist the court in a fair and transparent manner. It was explicitly stated that the committee has not been established to serve the interests of any single party but to uncover the truth behind the incidents.

Witness Protection and Evidence Submission

Recognizing the sensitivity of the case, the Supreme Court has issued strict instructions to the HPEC regarding the protection of witnesses. The court directed that any sensitive or vulnerable witnesses who come forward to provide testimony must be provided with adequate security. Their identities are to be kept strictly confidential to prevent any form of intimidation or retaliation. Also, all statements and evidence provided by these witnesses must be maintained with the highest level of confidentiality.

To facilitate the collection of evidence, the court suggested the creation of a dedicated online portal. This platform will allow witnesses and other concerned individuals to submit documents and evidence securely. This move follows the Supreme Court's announcement last month regarding the formation of the High-Powered Committee to investigate the student protests at Jantar Mantar.

Appointment of Amici Curiae and Administrative Support

To further assist the court and the HPEC, the Supreme Court has appointed two senior legal professionals as Amici Curiae. Dr. Monika Gusain, a Senior Advocate, and C, while solomon, Advocate-on-Record (AOR), have been designated for this role. They will serve as representatives of the HPEC and act as independent mediators between the various parties involved. The court has also instructed the HPEC to appoint a Member Secretary as soon as possible to handle administrative duties and other essential tasks. The committee is expected to file its first report in the near future.

Protection for 14 Year Old Protester

In a related petition, the court addressed the safety concerns of a 14 year old protester. It was brought to the court's attention that the young girl and her family have allegedly been receiving death threats. Taking serious note of this, the Supreme Court directed the Delhi Police to conduct a threat assessment and provide necessary security to the girl and her family. The police have also been ordered to expedite the investigation against those allegedly responsible for the threats and harassment. A status report regarding this matter must be filed by the Delhi Police before the next hearing, which is scheduled for 9 October.
