While the legislator received relief in two previous cases, a fresh legal challenge has emerged with the registration of a new FIR at the Junction police station. The new case involves allegations related to a land dispute, marking a complex turn in the political and legal landscape of the region.
New FIR and Allegations of Land Dispute
A fresh case has been registered against MLA Ganesharaj Bansal and 8 unidentified individuals at the Junction police station in Hanumangarh. The complaint was lodged by Harbans Singh, a resident of Civil Lines. According to the details provided in the complaint, the MLA and his associates are accused of demolishing a boundary wall built on a plot. Plus, the complainant has alleged that there were attempts to illegally transfer the ownership of the said plot into the names of the MLA's relatives. Following a preliminary investigation, the police officially registered the case. Given that the matter involves a sitting Member of the Legislative Assembly, the investigation has been formally handed over to the CID-CB for further scrutiny.
Legal Sections and CID-CB Investigation
The police have invoked several sections of the Bharatiya Nyaya Sanhita (BNS) in this new FIR. The case has been registered under sections 308(2), 329(4), 331(6), 324(4), 324(5), 191(2), 191(3), and 190. These sections cover various aspects of the alleged offenses related to property damage and illegal assembly. The transfer of the case to the CID-CB is a standard procedural requirement for cases involving elected representatives, ensuring a specialized level of investigation into the allegations leveled by Harbans Singh.
High Court Quashes Two Previous FIRs
Amidst the registration of the new case, the Rajasthan High Court Bench in Jodhpur has provided a major reprieve to the MLA. The single bench of Justice Ashok Kumar Jain quashed two FIRs that were previously registered at the Hanumangarh Junction police station. This order came during the disposal of criminal miscellaneous petitions filed by petitioner Santosh Bansal. The court's decision has brought relief not only to Ganesharaj Bansal but also to Santosh Bansal and Vandana Jain, who were named in those cases. The previous FIRs were centered around allegations of fraud and the issuance of leases based on forged and fabricated documents. It's noteworthy that on September 23, the High Court had already granted an interim stay on arrests and any punitive action in these matters, reserving the detailed order which has now been delivered. Advocates Kunal Upadhyay and Vinod Sharma represented Ganesharaj Bansal during the proceedings.
MLA Claims Political Vendetta
Reacting to these developments, MLA Ganesharaj Bansal has termed the legal actions as a result of political rivalry. In his statement, he linked the timing of the FIRs to the upcoming local body elections. He stated, "All of this is related to political animosity and the municipal body elections. Cases were registered against me and I was even arrested just before the chairperson elections. " The MLA expressed his unwavering faith in the judicial system, noting that the High Court has already stayed and quashed the previous two cases. He expressed confidence that in the new matter as well, the truth will eventually prevail, stating that "milk will be separated from water" through the legal process.
