Dr. John Brittas, a prominent Rajya Sabha Member of Parliament and leader of the Communist Party of India (Marxist), has formally approached the Chief Justice of India (CJI) following an incident of alleged manhandling and assault by security forces in the national capital. In a detailed letter, the MP has sought immediate judicial intervention and requested that the investigation into the matter be conducted by an agency independent of the Delhi Police and the Central Reserve Police Force (CRPF). He further urged that any such probe should be placed under the direct supervision of the Supreme Court of India to ensure transparency and accountability.

Details of the Alleged Assault and Misconduct

The incident reportedly took place during a democratic protest where participants were demanding the resignation of Chief Election Commissioner Gyanesh Kumar. According to Dr. Brittas, he was engaged in a conversation with members of the press when personnel from the Delhi Police and the CRPF allegedly began to mistreat him, while the MP claimed that he was forcibly dragged and lifted by the security personnel before being thrown into a police vehicle. He further alleged that the physical assault continued even inside the vehicle, after which he was eventually abandoned on the side of a road. Dr. Brittas emphasized that the security forces acted with high-handedness despite being aware of his status as a Member of Parliament.

Timing Relative to Supreme Court Directives

A significant portion of the letter highlights the timing of the incident. Dr, while brittas pointed out that the alleged assault occurred only a few hours after the Supreme Court had issued specific directives regarding the management of protests in Delhi. These judicial instructions were aimed at ensuring that peaceful and unarmed individuals are detained only in accordance with the law, and that public transport services and the free movement of citizens aren't unnecessarily hindered. The MP argued that the occurrence of such an incident so soon after the court's orders raises serious questions about whether constitutional rights and judicial mandates are being respected by law enforcement agencies.

Demand for Accountability and Evidence Preservation

Dr. Brittas has called for a thorough investigation that not only identifies the personnel on the ground but also determines the responsibility of senior officers. He noted that the concerned Deputy Commissioner of Police (DCP) was aware of the situation and it was only after the DCP's intervention that he was released, while to ensure a fair trial, the MP has requested the preservation of all critical evidence, including video recordings of the incident, CCTV footage from the area, identification of the police vehicle involved, duty rosters, official orders, wireless communication logs, and all records related to the detention.

Constitutional Violations and Legal Recourse

The letter invokes several constitutional provisions, specifically Article 19 and Article 21. Dr. Brittas stated that Article 19(1)(a) and 19(1)(b) protect the fundamental rights to freedom of speech and peaceful assembly. On top of that, Article 21 guarantees the right to life and personal liberty. He asserted that peaceful protest or the criticism of the government and constitutional institutions can't be used as a justification for the use of physical force, while he maintained that any form of detention or use of force must be lawful, necessary, and proportionate. Consequently, he has requested the CJI to treat his letter as a petition under Article 32 of the Constitution, emphasizing that this isn't merely about the mistreatment of an MP but involves broader questions regarding the freedom of citizens, police accountability, and the rule of law.

Request for a Special Investigation Team

Finally, the Rajya Sabha MP has urged the Chief Justice to consider the formation of a Special Investigation Team (SIT) comprising officers who aren't associated with the Delhi Police or the CRPF units involved in the incident. He has requested that the SIT or an independent agency submit a status report to the Supreme Court within a specified timeframe. Also, he sought protection for journalists and witnesses from potential pressure or retaliation and mentioned previous concerns regarding the detention of other opposition leaders who were allegedly denied timely access to food and essential medicines.
