Bombay HC Dismisses Anita Advani Appeal, Relief For Dimple Kapadia

The Bombay High Court on Wednesday dismissed an appeal filed by actor Anita Advani seeking to accord her relationship with the late superstar Rajesh Khanna the status of a relationship in the nature of marriage. Justice Sharmila Deshmukh upheld the earlier decision of the Dindoshi Civil Court which had dismissed Advani's civil suit on technical grounds. This judicial order brings significant relief to Dimple Kapadia, Akshay Kumar, and Twinkle Khanna who have been embroiled in this legal battle for over a decade. The legal conflict between Anita Advani and the Khanna family originated shortly after the superstar's demise in 2012. Advani had claimed that she was in a long-term live-in relationship with the actor at his iconic Bandra bungalow 'Aashirwad', while she alleged that she was forcibly evicted from the premises following his death and subsequently filed a case under the Protection of Women from Domestic Violence Act 2005 seeking maintenance and residence rights. Anita Advani moved the Bombay High Court after the Dindoshi Civil Court dismissed her claims in 2017. During the High Court proceedings her legal counsel argued that the relationship shared the characteristics of a marriage and That's why she was entitled to legal protection and rights over the estate. Conversely the legal team representing Dimple Kapadia and her family argued that since Rajesh Khanna and Dimple Kapadia were never formally divorced any other relationship maintained by the actor couldn't be legally recognized as a marriage-like union under Indian law.

Advani had initiated criminal proceedings for domestic violence against Dimple Kapadia, Twinkle Khanna, and Akshay Kumar in a Bandra Magistrate court, while she maintained that she was the primary caregiver for Rajesh Khanna during his final years and that their cohabitation was a matter of public knowledge. Her primary legal contention was that the duration and nature of their stay together qualified her for benefits under the Domestic Violence Act. However the Khanna family maintained that her presence in the house didn't confer any legal status or right to the property.

In 2015 a coordinate bench of the Bombay High Court had quashed the domestic violence proceedings against Dimple Kapadia and her family members. At that time the court clarified that Advani's relationship with Rajesh Khanna didn't fall under the category of a relationship in the nature of marriage as defined by the 2005 Act. The court emphasized that for a live-in relationship to be treated as a marriage-like union certain legal prerequisites must be met including the parties being otherwise qualified to marry which wasn't the case here due to the subsisting marriage with Kapadia.

The court found that the civil suit filed by her wasn't maintainable as per the procedural laws cited by the lower court.
