Bulldozer will not stop in MP / High Court dismisses the petition filed against the action, denies the issue of public interest

In many districts of Madhya Pradesh, these days the district administration is taking action to bulldoze the house of the accused after registering a criminal case. A public interest litigation was filed in the Madhya Pradesh High Court against the bulldozer action, which was dismissed by the High Court's Chief Justice Ravi Vijay Kumar Malimath and Justice PK Kaurav, refusing to consider it an issue of public interest.

In the petition filed on behalf of advocate Amitabh Gupta, it was said that action is being taken by the police and administration to demolish the houses of the accused after registering criminal cases in different districts of the state. Along with the petition, copies of the news published in the newspapers regarding the action of Indore, Bhopal, Ujjain, Khargone and other districts were presented. It was said in the petition that without giving an opportunity of being heard, the action of demolition of the houses of the accused registered with the bulldozer is illegal.

Along with the petition, a copy of the news published in the newspaper was also presented, in which the action of demolition of Abdul Rafiq's house in Ujjain was described by former Supreme Court judge Deepak Gupta as a mockery of the law. It was said in the petition that such action creates fear in the minds of the people. Additional Advocate General Ashish Anand Bernad said that during the hearing of the petition, the bench was told that action has been taken by the administration on illegal construction. The petitioner has filed the petition only on the basis of the news published in the newspapers. The party concerned has not filed any petition against the action. The hearing of the issue raised was dismissed by the Couple Bench considering it not in public interest.
