The Supreme Court has given a shock to the army in the matter of giving permanent commission to women military officers. The Bench headed by Justice DY Chandrachud gave the verdict today in the matter of awarding permanent commission to the Short Service Commission. The court said that society is created by men for men, if it does not change then women will not get equal opportunities.
Justice Chandrachud said that the method of ACRs to give permanent commission in the army to women officers is discriminatory and arbitrary, this method of army will not give the same opportunity to give permanent commission to women. The court has directed the eligible women officers of the permanent commission to take charge within two months.The Supreme Court has said that the process of maintaining the confidential record of the ACR or service should be more transparent, the procedure for its evaluation should be decided afresh so that no officer is discriminated against. Despite its decision in February 2020, the Supreme Court ruled that many women officers in the army were not given permanent commission despite their fitness and other qualifications and conditions being met.The Supreme Court said that the Delhi High Court gave its first verdict in 2010, even after 10 years, it is not right to not give permanent commission on the basis of medical fitness and body size, this discrimination is complete and unfair.The Supreme Court directed the Army to consider giving permanent commissions for women officers within a month and following the due process, these officers should be given permanent commissions within 2 months.Earlier last year, the Supreme Court had ordered the Permanent Commission to be given to women. The Delhi High Court had also ordered the Permanent Commission to be given to women in 2010, but only 161 out of 284 women have been given Permanent Commission. These people were rejected on the medical ground.Today the Supreme Court said that those who have been rejected should be given one more chance. The Supreme Court held that the Army's medical criterion was not right, discriminating against women. The Supreme Court in its judgment said that women officers should be judged according to the medical standard they were in in their tenth year of their job.
