The Kerala High Court has given a big decision in a case regarding the relationship of husband and wife. The court has said that if the wife talks to a foreigner late at night despite the husband's repeated refusal, then it will be classified as marital cruelty. The court granted divorce to the couple on this basis. Let us inform that the husband had appealed in the High Court against the decision of the Family Court. The husband had cited cruelty and adultery for divorce in the petition.

The court said that the evidence given regarding the phone call was not sufficient to prove that the woman was committing adultery. The court said that the relations between the two parties have not been good and they have parted ways three times before. In such a situation, the wife should have been more careful about her relationship, although she did not do so.

The relationship between this couple has not been good even before. In the year 2012, the wife had accused the in-laws of atrocities. Even before this, the husband suspected that the wife was in a relationship with another man. The woman had relations with him in the office before marriage which continued even after marriage. The court rejected the case of adultery and said that the husband never saw the wife and the third person together, so the evidence was not sufficient to prove it.

The husband had told the court that once he had overheard the private conversation between the wife and the third person. When questioned, the wife said that the man has more authority over her body and mind than the husband. According to the husband, the wife continued to talk to him despite stopping. She used to talk to him several times in a day. Although the wife said that sometimes she used to call him.

According to the documents submitted in the court, the wife used to call the third person several times a day. They used to talk even during the night. Regarding this matter, the court said that it should be kept in the category of marital cruelty.
