The Disputed Will and its Contents

Sanjay Kapoor passed away on June 12, 2025, in London due to cardiac arrest. Forty-seven days after his demise, a will dated March 21, 2025, was presented by Priya Kapoor. This will purportedly bequeaths all of Sanjay Kapoor's personal property to Priya, completely excluding his second wife Karisma Kapoor, their children Samaira and Kiaaan, and his mother Rani Kapoor. This exclusion is a significant point of contention, particularly highlighted by the children's lawyer, Mahesh Jethmalani, as it deviates from the typical behavior of a father towards his offspring.

Inconsistent Testimony of the Executor

During the Delhi High Court hearing on Thursday, Shraddha Suri. Marwah, named as an executor in the will, provided inconsistent statements. Initially, Suri claimed she received the will from Priya. However, she later changed her statement, asserting that a person named 'Dinesh Agarwal' emailed her the will on June 14, asking her to become an executor. This email initially contained a trust deed by mistake, with the correct will sent later. Such a sequence of events is considered highly suspicious legally, suggesting a lack of transparency in the will's process.

Doubts Over Suri's Claims

Shraddha Suri Marwah also admitted that she was unaware of being appointed as an executor of the will. She stated she had no lawyer and was uncertain about the will's veracity. These admissions further fuel the suspicion that the document was handed to her later, rather than Sanjay Kapoor himself entrusting her with this crucial responsibility, while an executor expressing doubts about the authenticity of the document itself raises a major question mark over the will's validity.

Priya Kapoor's Contradictory Assertions

Priya Kapoor had initially informed Suri that this was Sanjay's final and only will. However, she later conceded in court that she was merely a nominee, not the owner. Under Indian law, a nominee only manages the property and doesn't hold ownership rights. These contradictory statements from Priya weaken her claims and generate further suspicion regarding the intent behind the presented will. This clearly indicates an inconsistency in Priya's statements, complicating the matter further.

Legal Anomalies and the Children's Stance

Mahesh Jethmalani, the lawyer representing Sanjay's children, pointed out several serious errors in the will. He highlighted incorrect names, surnames, addresses, and confusing language. In multiple instances, Sanjay Kapoor himself is referred to as the "will giver. " Jethmalani argues that a Harvard-educated businessman and owner of a 30,000 crore business empire like Sanjay Kapoor would never have approved a will with such glaring mistakes. This suggests that the will might have been prepared in haste or under someone else's influence.

Implications if the Will is Proven Fake

Should this won't be proven authentic in court, Sanjay Kapoor's property would be divided equally among all legal heirs, particularly his children Samaira and Kiaaan, according to Indian succession law, while suri's lawyer also acknowledged this in court. Plus, Suri sought compensation from Priya, which isn't typical behavior for an executor if they had faith in the will. She also stated that she never felt the need to probate the will, indicating that proper legal procedures might not have been followed.
