NDA vs INDIA: Bill related to transfer and posting of officers in Delhi will be introduced in Lok Sabha today. On Tuesday, the cabinet under the chairmanship of Prime Minister Modi had approved this bill. There is bound to be a tussle between the NDA and the India alliance on this issue. Kejriwal has appealed to all BJP opponents to drop this bill in Parliament and said that if the opposition is able to stop the passage of this bill, it will be a big defeat for the government.

If we talk about the Lok Sabha, then the government has enough numbers to pass the bill. The BJP alone has 301 MPs in the Lok Sabha with a total of 543 seats, while the number becomes 333 if the NDA MPs are taken together. On the other hand, the Congress-led India coalition has 142 MPs, which means the government's path in the Lok Sabha will be easy. The Aam Aadmi Party says that the opposition's no-confidence motion against the government has been approved, it is against the rules to bring this bill in Parliament before it is discussed.

The Aam Aadmi Party has got the support of most of the opposition parties on the ordinance. The Congress has given a big relief to Kejriwal by announcing its opposition to the ordinance just before the Bengaluru meeting. Now the big question is whether the central government will easily pass this bill in the Rajya Sabha like the Lok Sabha or will the opposition be able to stop it in the Rajya Sabha.

Will the government pass the bill in Rajya Sabha?

The total number of members in Rajya Sabha is 237. In such a situation, 119 MPs are needed to pass any ordinance here. Here the number of MPs of BJP is 92, if nominated MPs are added then this number becomes 97. Along with this, if the MPs of the parties involved in the NDA are included, then this figure becomes 111. The government is still short of 8 MPs to get the ordinance passed. Obviously, in such a situation, the government will need support from the parties running away from both NDA and India.

BJD has 9 MPs in Rajya Sabha, BRS 7 and YRS Congress 9, JDS, TDP and BSP have one MP each. The number of these parties running away from NDA and India is 28 in Rajya Sabha. Looking at these parties, it seems that it is not difficult for the government to get the support of 8 MPs.

What is the figure with Kejriwal

Even if Kejriwal gets the support of 30 Congress members in the Rajya Sabha, their total number will be 98. In such a situation, it may be difficult for Kejriwal to return this ordinance in the Rajya Sabha and he does not see any relief even after getting the support of the Congress. While there are only 142 MPs in the Lok Sabha, the India coalition will not be able to encircle the government.

What is the Ordinance of Delhi?

The Central Government has formed the National Capital Service Authority. It only has the authority to transfer officers of Delhi. Three members have been kept in it, which includes the Chief Minister, the Chief Secretary and the Home Secretary. Along with this, this authority will take a decision by majority. Whatever two of these three people agree on, it will be valid. Regarding this, Delhi CM Arvind Kejriwal is feeling that his powers are being snatched away. Along with this, if there is a disagreement on anything, then the words of the Lieutenant Governor will also be considered. Section 45D is also attached to this ordinance.

The real reason for the tussle between the Center and the AAP government

The Kejriwal government is opposing the central government's ordinance because it believes that this ordinance is an attempt to weaken the elected government of Delhi. The Ordinance gives control over transfer and posting of IAS and DANICS officers in Delhi to the Lieutenant Governor of Delhi appointed by the central government. This means that the elected government of Delhi will no longer have the final authority on who is appointed to these important posts.

The Kejriwal government argues that the ordinance is unconstitutional as it violates the principle of separation of powers. The Constitution of India gives the power to the elected government of Delhi to control the administration of Delhi. The ordinance takes away this power and gives it to the National Capital Service Authority and the Lieutenant Governor, who is not an elected official.

The Kejriwal government also argues that this ordinance is undemocratic. The people of Delhi elected the Aam Aadmi Party to rule Delhi. This ordinance undermines the will of the people by giving control over the administration of Delhi to the Lieutenant Governor appointed by the central government.
