MP Hanuman Beniwal will not have to vacate the MLA residence for now. Hearing his petition, a single bench of Justice Sameer Jain has stayed the action of the estate officer. Hearing Beniwal's petition, a single bench of Justice Sameer Jain has stayed the ongoing action to vacate the MLA residence. Along with this, the court has issued a notice to the state government and sought a reply.

Allegation of ignoring the principle of natural justice

Hanuman Beniwal had claimed in his petition that the principles of natural justice are not being followed in the process of vacating the MLA residence. His advocates Sumitra Chaudhary and Premchand Sharma told the court that the estate officer had issued a notice to vacate the house on July 1 on the basis of the government's application. The first hearing took place on July 11, but after that the estate officer is showing unnecessary haste.

The advocates also argued that the applications filed on behalf of Beniwal were rejected arbitrarily and with derogatory remarks. He said that this conduct of the estate officer reflects his biased attitude, which appears to be in favor of the state government. Beniwal demanded that the notice issued by the estate officer and the action being taken on that basis be canceled.

The flat was allotted two years ago

Hanuman Beniwal was allotted flat A-3/703 in the MLA residence in front of the Vidhan Sabha in Jaipur about two years ago. However, after he became an MP in the Lok Sabha elections, the government filed an application before the estate officer to vacate this house in June 2025. During the hearing on this application, the estate officer had issued a notice, which has now been stayed by the court.

Court's decision and next hearing

The single bench of Justice Sameer Jain has sought a reply from the government while putting an interim stay on the action of the estate officer. The date of the next hearing in this case will be decided soon. This court order is an important relief for Beniwal, as it will not require him to vacate the MLA residence for the time being.
