Shri Krishna Janmasthan: The Supreme Court has banned the survey at the Shahi Idgah Mosque in Mathura, Uttar Pradesh. The Muslim side had demanded a ban on the Court Commissioner survey. He had challenged the order of Allahabad High Court. The High Court had ordered a survey in the mosque. Advocate Tasneem Ahmadi, citing a Supreme Court decision on Tuesday, said that where the maintainability of a civil suit is questioned and the grant of interim relief is opposed on that ground, then before taking the decision to grant interim relief, The trial court should at least hear the case together.

He said that there should be prima facie satisfaction regarding the case. The Supreme Court said that it is issuing notice on the application of the Muslim side. This is a matter of legal aspect. Let us tell you that there is a dispute over 13.37 acres of land in Mathura. Shri Krishna's birthplace temple is situated on about 11 acres. Shahi Idgah Mosque is on 2.37 acres of land. Aurangzeb built the Shahi Idgah in 1669-70. It is claimed that he had demolished the ancient Keshavnath temple built at the birthplace of Shri Krishna.

In 1935, 13.37 acres of disputed land was allotted to the Raja of Banaras by the High Court. This land was acquired by Shri Krishna Janmabhoomi Trust in 1951. In 1968, an agreement was reached between Shri Krishna Janmasthan Seva Sangh and Shahi Eidgah Committee. A petition was filed demanding that the Shahi Eidgaad land be given to the Hindu side. In the petition, there was also a demand to cancel the agreement made in 1968.

What do Hindu and Muslim sides claim?

The Hindu side claims that Aurangzeb had destroyed the temple in 1670. Idgah Mosque has been built by illegal encroachment. Attempts were made to damage Hindu symbols, temple pillars and Hindus were being prevented from worshipping.

At the same time, the Muslim side claims that there is no evidence in history to build a mosque by demolishing a temple. The facts are being distorted. The temple trust has no objection to the 1968 agreement. The Places of Worship Act should be followed.

What is the 1968 agreement?

Shri Krishna Janmabhoomi Trust was formed in 1946. The Trust compromised with the Muslim side. The management of Shahi Eidgah was handed over to Muslims. Muslims were asked to vacate the premises. A wall was built to protect the temple and mosque. It was decided that the mosque would not have a window towards the temple. The petitioner claims that the 1968 agreement is a fraud. There were demands to cancel the 1968 agreement.
