Gyanvapi Masjid Case: Allahabad High Court's decision will come on August 3 on whether ASI survey of Gyanvapi Masjid will be done or not. Till then the ban on ASI's survey will continue. The Muslim side is against the Archaeological Survey of India (ASI) survey. He believes that this may damage the historical structure. Muslim side's lawyer Farman Naqvi has filed a reply to ASI's affidavit in the High Court. Chief Justice (CJ) asked what is the legal identity of ASI?

On this, the court has been told that the ASI was constituted in 1871 for the protection of the monument, and monitors the archaeological remains. Naqvi, the lawyer for the Muslim side, said that the matter on which the lower court had heard, that case itself is not hearable and is pending in the Supreme Court.

At the same time, it has been said from the Hindu side that the temple is under the protection of CISF. The Attorney General says that our job is to maintain law and order. The court asked the question from the Hindu side that why there is delay in deciding the case? Hindu side's lawyer Vishnu Shankar Jain gave information on the question of the court. Muslim side's lawyer Syed Farman Ahmed Naqvi said that the case was handed over to the district judge from the civil judge. Outsiders have filed suit. A total of 19 cases have been filed in this case in Varanasi.

Even after being apprehensive, the Hindu side insisted on the survey - the Muslim side said

Naqvi said that there is apprehension, yet he is insisting that he will conduct the survey. CJ said but only on the basis of your apprehension they cannot be kept away from their legal rights. Naqvi said that the rest depends on the order of the court. The CJ said show us a single example of such activity taking place after the order was passed.

Naqvi said that until the Supreme Court gives an order on whether the case related to civil claim (proprietary rights) is hearable or not, it is not appropriate to conduct the survey. The Chief Justice said, but no demand has been made from your side for early settlement. Naqvi said that the Hindu side tried its best to claim that no digging is taking place, but we have photographs where they have used spades. They reached there with these equipments.

The talk of the temple under the Gyanvapi mosque is imaginary - Muslim side

The High Court asked whether they have used it? Naqvi said that since the stay was granted, otherwise it would have been used. The High Court said that if someone comes to the court with a weapon, it does not mean that he will use it. Naqvi said that it is not for entertainment that someone will come to the court with weapons. What chance do these people have to use spade etc.?

Raising the matter in the High Court on the previous day, the Masjid Committee had said that the Gyanvapi Masjid is present next to the prestigious Kashi Vishwanath Temple for 1000 years. Regarding the survey, the Ayodhya Ramjanmabhoomi case was cited by the Hindu side, on which the Masjid Committee says that those circumstances were different and cannot be compared. The counsel for the petitioners says that the talk of the temple under the Gyanvapi mosque is imaginary, for which there cannot be a basis for allowing the ASI to conduct the survey.
