Rajasthan Assembly: Minister Assures Compassionate Appointment for Comatose Constable's Family

Rajasthan Law Minister Jogaram Patel assured the Assembly that the family of Constable Subhash Chandra, who has been in a coma since 2015, will receive a compassionate appointment. This follows budget amendments allowing such appointments for permanent disability caused by illness, addressing a long-standing demand by MLA Amit Chachan.

The issue of providing a compassionate appointment to the family of Constable Subhash Chandra, a resident of Lalana village in Nohar, was raised in the Rajasthan Legislative Assembly on Tuesday. MLA Amit Chachan brought the matter to the floor, highlighting the plight of the family. In response, Law Minister Jogaram Patel assured the House that the state government would take prompt action following recent budget amendments to provide relief to the affected family.

Legislative Intervention by MLA Amit Chachan

During the session, MLA Amit Chachan informed the House that Constable Subhash Chandra collapsed while on election duty in 2015. Since the incident, he has remained in a continuous state of coma and has been declared permanently and totally disabled. The MLA demanded that under point number 14 of the Rajasthan Compassionate Appointment of Dependents of Permanently Totally Disabled Government Servants Rules 2023, the Constable's son, Rahul Kadwasra, should be appointed as a Junior Assistant using special powers.

Technical Hurdles and Previous Regulations

The discussion revealed that departmental officials had previously rejected Rahul Kadwasra's claim for appointment based on technicalities. According to the 2023 rules, compassionate appointment was only applicable if the permanent disability resulted from an accident while on duty. Since Subhash Chandra's condition was categorized as a disability arising from an illness (coma), the department had deemed the case ineligible, despite a certificate from the Chief Medical and Health Officer confirming his permanent disability.

Budget Amendments and Government Response

Law Minister Jogaram Patel clarified the government's stance, stating that the state budget has introduced significant amendments to the rules governing compassionate appointments, while he explained that while the previous framework only covered accident-related disabilities, the new amendments extend these benefits to cases where permanent disability is caused by severe illness. The Minister emphasized that the government views this as a matter of humanitarian importance and is committed to resolving it.

Financial Hardships of the Affected Family

The MLA highlighted that Subhash Chandra was the sole breadwinner of his family. For the past 10 years, his medical condition has pushed the family into a severe financial crisis. Although MLA Amit Chachan has been pursuing this case for seven years and some relaxations were introduced in 2023, administrative delays and procedural interpretations had prevented the family from receiving the appointment until now.

Assurance of Prompt Administrative Action

Minister Jogaram Patel assured the Assembly that the government is in the process of implementing the budget declarations. He stated that departmental instructions would be issued shortly to expedite the case of Subhash Chandra. The government reiterated its commitment to ensuring that the dependents of government employees who become completely incapacitated during their service period are provided with livelihood security through such appointments.
