Samajwadi Party leader Azam Khan did not get relief from the Supreme Court in the 2007 hate speech case. The court refused to transfer the case to Delhi and dismissed the petition. Kapil Sibal alleged tampering of evidence, but the court said that this cannot be the basis for transfer.

Supreme Court News: Senior Samajwadi Party leader Mohammad Azam Khan has not got any relief from the Supreme Court in the case of alleged inflammatory speech given in 2007. The Supreme Court has rejected his petition to transfer the case to Delhi. The court clarified that this decision will not prevent the petitioner from seeking other legal remedies regarding the change in the court record.

Azam Khan's argument

Azam Khan had made a serious allegation of tampering with evidence in his petition. It was argued on his behalf that the original file of the alleged inflammatory speech was submitted to the court in the form of a video clip, but it was later tampered and converted into an audio file. He described this change as part of biased action against him.

Kapil Sibal's side

Senior advocate Kapil Sibal, on behalf of Azam Khan, presented arguments before a bench of Justice MM Sundaresh and Justice NK Singh. He said that the petitioner has obtained a certified copy of the clipping, which is clearly a video clipping. Sibal argued that if the original evidence is allowed to be changed from video to audio, the petitioner can be convicted on the basis of that audio. He asserted that the court record has been altered, which is a threat to a fair trial.

Supreme Court verdict

Justice MM Sundaresh orally remarked that the allegation of tampering with evidence cannot be a ground for transferring the case. The court dismissed the petition and made it clear that the petitioner is free to pursue other legal avenues, but the request for transfer cannot be accepted. Justice Sundaresh said, "Whatever you want to do, this is not a ground for transfer."
