The legal battle involving the former chief of the Wrestling Federation of India (WFI) and Bharatiya Janata Party leader Brij Bhushan Sharan Singh has reached a critical juncture, while on Wednesday, the Rouse Avenue Court in Delhi concluded the hearing of arguments from both the prosecution and the defense regarding the sexual harassment allegations leveled against him. Following the conclusion of these proceedings, the court officially reserved its verdict, marking a significant step in a case that has garnered national attention for over a year.
Verdict Scheduled for August 3
Additional Chief Judicial Magistrate Ashwini Panwar, who presided over the hearings, announced that the final order regarding the conviction or acquittal of Brij Bhushan Sharan Singh will be delivered on August 3, 2024. During the final session, the court directed both the parties involved to submit their written arguments within the next 2 weeks. This period will allow the legal teams to consolidate their points before the judge makes the final determination. The court heard detailed submissions from Senior Advocate Rebecca John, representing the female wrestlers, Advocate Rajiv Mohan, representing Brij Bhushan Sharan Singh, and the public prosecutor appearing on behalf of the Delhi Government.
Background of the Allegations
The case stems from serious allegations of sexual harassment made by 6 prominent female wrestlers against Brij Bhushan Sharan Singh. These complaints led to a massive protest and subsequent police investigation. Based on the complaints, the Delhi Police registered an FIR and conducted a thorough probe into the matter, while on June 15, 2023, the police filed a comprehensive chargesheet against Singh. The charges were filed under several sections of the Indian Penal Code (IPC), including Section 354 (assault or criminal force to woman with intent to outrage her modesty), Section 354A (sexual harassment and punishment for sexual harassment), Section 354D (stalking), and Section 506(1) (criminal intimidation).
Framing of Charges and Evidence
A major milestone in the trial occurred on May 10, 2024, when the trial court formally framed charges against Brij Bhushan Sharan Singh. The court observed that there was sufficient evidence on record to proceed with a trial for the offenses punishable under IPC Sections 354 and 354A concerning the harassment of 5 female wrestlers. Also, the court found that there was enough evidence to frame charges under IPC Section 506(1) for criminal intimidation in relation to 2 of the wrestlers. These findings by the court established a prima facie case against the former WFI chief, leading to the final stage of arguments that have now concluded.
Involvement of Co-accused and Minor's Case
The legal proceedings also involved Vinod Tomar, the former Assistant Secretary of the Wrestling Federation of India, while the court framed charges of criminal intimidation against Tomar for allegedly threatening one of the victims. While the case involving the 6 adult wrestlers proceeded, a separate complaint had been filed by a minor wrestler under the Protection of Children from Sexual Offences (POCSO) Act. However, the minor later withdrew her complaint and changed her statement. Consequently, the Delhi Police filed a cancellation report in the POCSO case, which led to the closure of that specific matter by the court. The current verdict scheduled for August 3 pertains specifically to the charges filed by the other female wrestlers under the IPC.
