What did the CJI say in the judgment?

CJI Chandrachud said, the elected government should get the powers to run the administration, otherwise it is a big loss to the federal structure. Officers who are posted for their duty should listen to the ministers, if this does not happen then it is a big flaw in the system. He should have the administrative system in the elected government. If the elected government does not have this authority, then the triple chain of accountability is not fulfilled. He said that NCT is not a full state, so the state does not come in the first list. The rights of NCT Delhi are less as compared to other states.

Decision taken with the consent of all the judges

The decision of a 5-judge constitution bench of the Supreme Court on the dispute over the right of transfer-posting of officers in Delhi was read out by CJI DY Chandrachud. Before pronouncing the verdict, he had said that this decision has been taken with the consent of all the judges. He said that this is the decision of the majority. The CJI, before pronouncing the verdict, said it was necessary to deal with the Centre's submissions to limit the powers of the Delhi government. Apart from this, he said that this matter is only about control of services.

This dispute was pending for a long time

On July 4, 2018, the Supreme Court had given judgment on several issues in the Center vs Delhi dispute but left some issues like control over services ie officers for further hearing. On February 14, 2019, a two-judge bench had given a decision on this issue, but the decision of both the judges, Justice AK Sikri and Justice Ashok Bhushan, was different. After this the matter came before a bench of 3 judges and finally a bench of 5 judges headed by Chief Justice DY Chandrachud heard the case. Now today the decision has come on this matter.
