Modi Surname Case: Congress leader Rahul Gandhi has refused to apologize in the Modi surname case. He filed an affidavit in the Supreme Court saying that the question of apologizing does not arise. Prima facie, this does not make out a case of defamation. Rahul Gandhi said that there is no act of apologizing. The Congress leader said these things in the affidavit filed in the Supreme Court. Rahul Gandhi said that the case against him is an exception, in view of which the conviction should be stayed. Rahul Gandhi demanded the Supreme Court to stay the decision of the Gujarat High Court. Rahul Gandhi files affidavit on Purnesh Modi's reply to his plea to stay conviction in 2019 defamation case.

What did Rahul Gandhi say in the affidavit?

Rahul Gandhi criticized Purnesh Modi, the petitioner associated with the case, for his reply on calling himself arrogant. Rahul said in his affidavit that Purnesh Modi used the word arrogant against me only because he refused to apologize and left the matter to the court.

Rahul Gandhi has said in his reply that by apologizing, the direction of the ongoing trial in the case can be changed. Also, using the criminal process and its consequences under the RP Act can also be an abuse of the process going on in the court. Rahul has said in his affidavit that no public representative can be forced to apologize without any mistake. This amounts to gross abuse of judicial process with criminal procedure under the Representation of the People Act and should not be accepted by the Supreme Court. The Supreme Court will now hear the matter on 4 August.
